Terms of Service for the Homzie App

1. Scope and Contracting Parties

1.1 These Terms of Service (hereinafter "Terms") govern the use of the mobile application "Homzie" (hereinafter "App") and all related services.

(hereinafter "Provider", "we", or "us")

1.3 A user of the App within the meaning of these Terms is any natural person who downloads and uses the App (hereinafter "User" or "you").

1.4 By registering in the App, you accept these Terms. Use of the App is only possible if you agree to these Terms.

1.5 Deviating terms of the User will not be recognized unless the Provider expressly agrees to their validity in writing.

2. Subject Matter and Service Description

2.1 Homzie is an app for organizing household daily life. The App enables users and their household members to jointly manage tasks, shopping lists, meals, and appointments.

2.2 Core features of the App include:

  • Task management with assignment to household members
  • Shopping lists with product search and management
  • Meal planning with participant management
  • Calendar for shared appointments
  • Recipe management
  • Household invitations and member management

2.3 The App is offered in a free basic version and a paid premium version ("Homzie Pro").

2.4 The range of features may vary depending on the version. The current features are available in the App and the respective app store.

2.5 The Provider reserves the right to change, expand, or restrict the range of features of the App at any time, provided this is reasonable for the User.

3. Registration and User Account

3.1 Use of the App requires registration and creation of a user account.

3.2 Registration is only permitted for persons of legal age (18 years or older) or minors with the consent of a legal guardian.

3.3 The following information must be provided truthfully during registration:

  • Email address
  • Name or display name

3.4 The User is obligated to keep their login credentials confidential and protect them from access by third parties. In case of suspected misuse of the account, the Provider must be notified immediately.

3.5 Each User may only create one account. The use of multiple accounts by the same person is not permitted.

3.6 The Provider may refuse registration without giving reasons.

4. Households and Members

4.1 Users can create households within the App and invite other users to join them.

4.2 The creator of a household (Administrator/Manager) has extended permissions, including:

  • Inviting and removing members
  • Managing household settings
  • Transferring the administrator role

4.3 The inviting user is responsible for only inviting persons who have given their consent to participate in the household.

4.4 Shared content within a household (tasks, shopping lists, meals, appointments) is visible to all household members.

5. In-App Purchases and Subscriptions

5.1 General

The App offers paid subscriptions ("Homzie Pro") that unlock additional features.

5.2 Contract Formation

The purchase contract for a subscription is concluded by confirming the purchase in the Apple App Store or Google Play Store. Payment processing is handled exclusively through the respective app store.

5.3 Prices and Payment Terms

a) Current prices are available in the respective app store.
b) All prices include statutory VAT.
c) Payment is made through the payment method linked to the app store account.

5.4 Duration and Renewal

a) Subscriptions are concluded for the selected term (monthly or annually).
b) Subscriptions automatically renew for the original term unless cancelled before the end of the current term.
c) Cancellation must be made at least 24 hours before the end of the current term.

5.5 Cancellation of Subscriptions

a) Cancellation is made exclusively through the respective app store:

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions

b) After cancellation, access to premium features remains until the end of the paid term.

5.6 Free Trial Periods

a) We may offer free trial periods for Homzie Pro.
b) After the trial period expires, the subscription automatically becomes paid unless cancelled before the end of the trial period.
c) Trial periods are generally available only once to new customers.

6. Right of Withdrawal for Consumers (EU)

6.1 Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

6.2 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

The refund will be processed through the respective app store.

6.3 Early Expiration of the Right of Withdrawal

The right of withdrawal expires in the case of a contract for the supply of digital content which is not supplied on a tangible medium if the trader has begun the performance of the contract after the consumer:

a) has expressly consented to the trader beginning the performance of the contract before the expiry of the withdrawal period, and
b) has acknowledged that they lose their right of withdrawal by giving such consent.

6.4 Note on App Store

As payment processing is handled through the respective app store, their withdrawal and refund policies also apply. Please refer to the terms of the Apple App Store or Google Play Store.

7. Usage Rights and Obligations

7.1 Grant of Usage Rights

The Provider grants the User a simple, non-transferable, non-sublicensable right to use the App for private purposes within the scope of these Terms.

7.2 User Obligations

The User agrees:

  • a) not to provide false or misleading information during registration;
  • b) not to use the App for illegal purposes;
  • c) not to post content that violates applicable law, in particular no offensive, defamatory, pornographic, or violence-glorifying content;
  • d) to respect the rights of third parties, in particular personal rights, copyrights, and trademark rights;
  • e) not to take technical measures that could impair the functionality or security of the App;
  • f) not to decompile, disassemble, or otherwise extract the source code of the App, unless permitted by mandatory law;
  • g) not to use automated systems (bots, crawlers) to use the App.

7.3 User Content

a) The User retains all rights to content they upload or create in the App.
b) The User grants the Provider the right to store, process, and display such content as part of providing the App services.
c) The User is solely responsible for the content they post and indemnifies the Provider against all third-party claims made on the basis of their content.

8. Availability of the App

8.1 The Provider strives for uninterrupted availability of the App as far as possible. There is no entitlement to availability at all times.

8.2 The Provider reserves the right to temporarily restrict the App if this is necessary for security reasons, technical maintenance, or due to force majeure.

8.3 The Provider is not responsible for disruptions that are outside its sphere of influence (e.g., failures of the User's internet connection, problems with the device's operating system).

9. Intellectual Property

9.1 The App, including all texts, graphics, logos, icons, images, audio clips, and software contained therein, is protected by copyright and is the property of the Provider or its licensors.

9.2 Reproduction, distribution, public access, or other exploitation of the App or parts thereof without the prior written consent of the Provider is prohibited.

9.3 "Homzie" and all related logos and trademarks are protected marks of the Provider.

10. Liability

10.1 The Provider is fully liable for damages based on intentional or grossly negligent breach of duty by the Provider, its legal representatives, or vicarious agents.

10.2 The Provider is fully liable for damages arising from injury to life, body, or health based on a negligent breach of duty by the Provider or an intentional or negligent breach of duty by its legal representatives or vicarious agents.

10.3 The Provider is liable for damages arising from breach of an essential contractual obligation (cardinal obligation), the fulfillment of which makes the proper performance of the contract possible in the first place and on the compliance with which the User may regularly rely. In this case, liability is limited to the typical, foreseeable damage.

10.4 Otherwise, the Provider's liability is excluded.

10.5 The above exclusions and limitations of liability do not apply to claims under the Product Liability Act or in the case of assumption of a guarantee.

10.6 The Provider is not liable for the loss of user data if the User has not taken appropriate backup measures.

11. Data Protection

11.1 The protection of your personal data is important to us. Information on the processing of personal data can be found in our Privacy Policy.

11.2 The Privacy Policy is part of these Terms.

12. Changes to the Terms

12.1 The Provider reserves the right to change these Terms with effect for the future if this is necessary for important reasons and the change is reasonable for the User.

12.2 Changes will be communicated to the User in text form (e.g., by email or in-app notification) at least four weeks before the planned effective date.

12.3 If the User does not object to the validity of the new Terms within four weeks of notification, the amended Terms shall be deemed accepted. The Provider will inform the User in the change notification of their right to object and the significance of the objection period.

12.4 In the event of an objection, both parties have the right to terminate.

13. Contract Term and Termination

13.1 The usage contract for the free basic version is concluded for an indefinite period and can be terminated by either party at any time without notice.

13.2 Termination by the User is effected by deleting the user account in the App settings.

13.3 The Provider may terminate the usage contract with two weeks' notice. Extraordinary termination for good cause remains unaffected.

13.4 Good cause exists in particular if:

  • a) the User violates material provisions of these Terms;
  • b) the User uses the App for illegal purposes;
  • c) the User provided false information during registration;
  • d) the User damages the reputation of the App or the Provider.

13.5 The termination of paid subscriptions is governed by the provisions in Section 5.

14. Final Provisions

14.1 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it is not contrary to mandatory provisions of the law of the state in which the consumer has their habitual residence.

14.2 Jurisdiction

For all disputes arising from or in connection with these Terms, the place of jurisdiction is Wuppertal, if the User is a merchant, a legal entity under public law, or a special fund under public law. For consumers, the statutory provisions apply.

14.3 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr/. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

14.4 Severability Clause

Should individual provisions of these Terms be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, the valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision shall apply.

14.5 Language

These Terms are available in German and English. In case of discrepancies, the German version shall prevail.
